    So help me out here... Instacart is laying off 20% of their 10,000 grocery store workers, yes? Of those 2,000 workers it includes the ten workers who voted to unionize at one store? I see no other...

    Of those 2,000 workers it includes the ten workers who voted to unionize at one store? I see no other unionized workers mentioned.

    I'm not saying Instacart isn't anti-union, hell just about any company is, but saying "Instacart is firing every worker who voted to unionize" seems disingenuous when "every worker" is half a percentage point of the total number being laid off.

      It's illegal for a company to fire an employee for unionizing. However, since pretty much all states have at-will employment, it's legal to fire an employee for almost any other reason (eg, being two minutes late to a shift, wearing the wrong kind of shirt, microwaving fish, etc). That said, courts aren't stupid -- if an employer immediately retaliates against an employee for unionizing with some dubious justification (eg, tardiness), courts will see through the BS and rule against the employer. However, if the action is more drastic -- shutting down all deli operations in six states, or firing all employees at "select retailer locations" --courts are more likely to divorce the two events, and so the employer is more likely to prevail. But it also sends a strong message to the remaining employees: you're expendable; unionize and suffer a similar fate.
