This is a New York case but it shook out similar to California's publicity laws. There is a prominent Vanna White case in California that lays out publicity rights. In that case, there was a Vanna White robot in an advertisement. By contrast, the image created by GTA V is not specifically created or modeled to look like Lohan and it's not a Lohan character in the game.

Lohan is also a lawsuit machine over things like this. It's impressive from a kind of disturbing perspective that her legal strategy is to not just sue all the things.

The blog I posted is written by Eric Goldman. He teaches IP law and he's also on his A game with explaining developments in the IP world, and particularly good at CDA 230 stuff.

It doesn't even remotely look or sound like her either. Lohan is crazy/paranoid and it's kind of sad to see how far she has fallen.

If anything, I think it looks really close to Kate Upton.
