It's also funny how fairly mainstream sources report on it as something just "neat", because so obviously nobody is harmed in any of this. There's rumors Nintendo has plans for a huge Mario bundle for the Switch (Mario 64, Sunshine, Galaxy and 3D World) and I can't think of any scenario in which this fan project could possibly hurt sales of that, for example. At the same time, yea, it's basically a pirate version of Mario 64, I couldn't blame them for suing.

Modding a console game that was unofficially ported to PC is unprecedented, so we don't really have a good point of comparison. Mod Texture Packs for Emulators are okay, because Emulators are okay, but a mod specifically created for an unlicensed copy of a game is... questionable.
I guess the game still exists somewhere though, so mods will be in similar places.

If they're just patch files, I don't see that Nintendo would have any claim. It's only a problem if the mod contains Nintendo code or assets.
That may be true but Nintendo can ruin people’s lives even without legal basis.
