A jury may have sentenced a man to death because he’s gay. And the Justices don’t care.

    TLDR, convict who would normally be given life in prison is sentenced to death because he would presumably enjoy all the men in prison. Somewhat misleading titlw, but still a horrible decision.

      I mean, that's still sentencing him to death because he's gay isn't it? The fact that he is gay, and would presumably enjoy all the men in prison, is the reason they changed the sentence.

      Yeah, the title is definitely clickbait. It should, at the very least, add a small clarifying point that the death sentence is a harsher alternative to what would ordinarily still be a pretty...

      Yeah, the title is definitely clickbait. It should, at the very least, add a small clarifying point that the death sentence is a harsher alternative to what would ordinarily still be a pretty heavy sentence. As it stands, however, the title is clearly intended to mislead the reader into believing that the man is receiving any sentencing simply for being gay. That is, rather than "man is guilty of crime -> would ordinarily receive life sentence -> is sentenced to death instead because he's gay", the title is meant to convey the message "man is not guilty of crime ->is gay, so is sentenced to death anyway". While both are still clearly terrible, there's a pretty big gap in the degree of awfulness between the two.

      Not surprising, though. This is an opinion piece.

          Typically, yes. Pointing that out seemed a bit unnecessary and would ruin the flow of my point, however :) Also, in some cases it could arguably be a preferable punishment for the convicted, e.g....

          Also, in some cases it could arguably be a preferable punishment for the convicted, e.g. in politically-motivated crimes where a death sentence would turn the convicted into a martyr for their cause and where that's the route that they're seeking. Obviously these sorts of situations are edge cases, but the point stands.

    The death penalty needs to be abolished, it's utterly barbaric and has been applied to innocent people a sickening number of times. (Though even once is far too many).

      That's a whole different argument, but I totally agree. However, the Americans do seem to like it, and they won't be talked out of it.

        I mean, just read the article. And this isn't in the heart of Alabama, it's in South Dakota. They're sending this man to his death simply because they think he will enjoy a lifetime of gay prison...

        I know I'm really late to this topic, but I would like to point out that the death penalty is state by state with 31 states using the death penalty and 19 not using it (mostly the typically Democratic voting states). The death penalty is mostly a Republican thing.
