    Ok...The title got me. This project has lots of controversy around it, but the "rain" damage isn't really one of them. The title should really be "Noah’s Ark theme park suing its insurance company...

    Ok...The title got me. This project has lots of controversy around it, but the "rain" damage isn't really one of them. The title should really be "Noah’s Ark theme park suing its insurance company for faulty retaining wall coverage" or something like that. The following quote is really the premise:

    But the insurance companies denied claims for the improvements, saying that the policy had an exclusion for correcting design deficiencies or faulty workmanship.

    The two sides went back and forth, according to the lawsuit and the insurance companies did pay a “very small portion” of Ark Encounter’s claim. But the organization says they have “breached their contractual obligations, acted in bad faith, and violated Kentucky law by failing to provide further coverage.”

    Unfortunately there isn't quite enough details in this article related to the retaining wall construction itself. Though, retaining walls are hardly rocket science, so I'm surprised they are suing their insurance and not their engineers.
