Honestly, it looks like the case as it is should be dismissed as frivolous. There is a case to be made, heard, and ruled on with the use of his image, regardless of, even ignoring, Elden's attempts to benefit from it on his own.
Hell, a case based on compensation would hold more water than a widely distributed album with nudity on the cover being child pornography. The lawyers just need to figure out an angle that doesn't try to succeed by claiming some outrageous use of his image.
Maybe they are more interested in getting media attention than in winning in court?
That's likely it.
