      The declaration is very likely to be stopped by this lawsuit as Trump himself mentioned in his announcement that it was not neccessary and he did not need to declare an emergency to make the wall built, it would just take longer (paraphrasing).

      There is a potential that if this gets all the way to the Supreme Court that the conservatove packed court could overturn a lower court ruling and allow the emergency declaration to stand. I would say the probability is fairly low for that though considering Chief Justice Roberts tends to support governing norms and precedent and I would wager he will side with the liberals here.

      Really the declaration is just a way for Trump to make a show for his base that hes trying to live up to his promise of a wall, while knowing this is likely to be tied up in courts and ultimately rejected.

        If the SC declares for trump in the face of deeply incriminating evidence then all hell is going to break loose come next election cycle, it will probably remove all pretence that the SC has not become an extension of the executive branch of government and the question of stacking it will become more appealing to whoever sweeps the victory in 2020.
