    this is an interesting and somewhat complicated legal issue that exists in california; there are several laws at play here that, depending on what DAs or lawyers or judges you ask, may or may not conflict and may or may not be constitutional. accordingly, this has created a whole clusterfuck of sentencing situations and generated a number of cases which are likely to go to the state supreme court and will have to be untangled there.

      in most other states, i suspect the charges here would indeed be something like or equivalent to manslaughter since these are california-specific statutes that were added by propositions.
