This is endemic to most regulatory agencies in my experience. I can’t count the number of times I have been told that my compliance is my responsibility, not theirs. I get it to some degree, as the staff are not generally lawyers — they are mostly inspectors who act as a buffer between the businesses and the regulator. They are told what to look for when it comes to a set of elements of non-compliance, but they don’t want to be on record as authorizing or sanctioning any kind of behaviour that turns out to not be correct later on. There should be a way to escalate these kinds of questions to someone with the authority to actually give an answer though.
