It's hard to believe Nevada becomes only the fourth state to outlaw this. Would the same sort of defence hold up for other intrinsic things which make us human? Can I invoke a "black panic"...

"My client experienced what is known among the top psychologists of the world as "hair panic." He only became aware that the victim had hair on her head when she took off her hat. The hat had obscured the entire top of her head, so my client was caught completely unaware when the victim revealed her hidden locks. The victim had neglected to tell to him that she was not bald, despite having many opportunities to do so, and so, acting in a state of complete and utter shock, my client bludgeoned her to death."

But someone else being black isn't a threat to your sexuality.

If the other person is gay or trans, however... then you're suddenly going to be the poor innocent victim of a nasty - and surprise - rape. Because that's how gay and trans people are. They're tricky. They pretend to be nice normal human beings in the light of day but, behind closed doors, they turn into evil vicious monsters who only want to prey on decent folks.

So those decent folks have no alternative but to lash out and kill the evil gay and trans monsters for their own protection. I mean... isn't that what happens when someone makes a surprise pass at you - you kill them? That's what women have been doing all these centuries whenever a man makes a surprise pass at them - they kill... oh, wait. That's right. This isn't about women. This is about men and how their sexuality is threatened when someone other than a cisgender female makes a pass at them.

I had no idea this was even a valid defense in the first place. It makes absolutely no sense.

i mean, it usually doesn't work as a defense insofar as people get off on their charges through it (which might be why it persists and why so few states have banned it), but it does have a tendency to lead to somewhat reduced sentencing.
