    I'm really having trouble with the use of the word "arrest" by many news organizations. I thought that being arrested meant being thrown in jail, or something to that effect. Is the usage correct...

    I'm really having trouble with the use of the word "arrest" by many news organizations. I thought that being arrested meant being thrown in jail, or something to that effect. Is the usage correct here, or everyone's forcing a little bit just because Trump should be in jail?

      It's more that there's a bunch of terms in the criminal prosecution process that get used interchangeably colloquially but actually mean very different things.

      For instance, a common "turns out" is that the majority of people in jail are not guilty of a crime - rather, they are awaiting trial. Jails are for short-term imprisonment - usually either people waiting for trial (note, not guilty yet), or very short term sentences (<1 year).

      The steps of a criminal prosecutions are usually 1) investigation 2) arrest (note, you are not guilty of anything at this point) 3) charging (an indictment is a formal accusation of a charge by grand jury) 4) arraignment (here, you first appear in court and start going through the court machinery) 4) pre-trial 5) trial 6) verdict 7) appeals

      So, due to the circumstances the charging was done prior to arrest in this case. We are at stage 4) now. Trump was investigated, charged, arrested, and arrainged. As he is evidently not determined to be a flight risk, he will not be kept in jail. Next will be pre-trial. A bunch of paperwork happens here.

      Then, the actual trial, where a jury will determine a verdict. When that is is being negotiated, but the prosecutors are asking for January 2024, so don't expect it anytime earlier.

      Only if he is guilty, and sentenced to incarnation, will Trump go to prison.

      The judge decided he did not need to be jailed or post a bail, technically he turned himself in because there is a warrant for his arrest (from the indictment). Him being cooperative is likely why...

      The judge decided he did not need to be jailed or post a bail, technically he turned himself in because there is a warrant for his arrest (from the indictment). Him being cooperative is likely why no cuffs, jail or bail until the trial. Sounds like the trial won't be until 2024.
