GDPR: Minimum age

Tags: gdpr

Hi,

in your terms you set the minimum age to 13, but AFAIK the GDPR requires a minimum age of 16 (without consent by parents).

Where point (a) of Article 6(1) applies, in relation to the offer of information society services directly to a child, the processing of the personal data of a child shall be lawful where the child is at least 16 years old. Where the child is below the age of 16 years, such processing shall be lawful only if and to the extent that consent is given or authorised by the holder of parental responsibility over the child.
Member States may provide by law for a lower age for those purposes provided that such lower age is not below 13 years.

    Thanks for pointing this out.

This new legislation is interesting on multiple levels. I'm still discovering new things in it.

Thanks for noticing this, I guess I'll need to make a change related to that in the next week.

Sidenote, how is Tildes going to notify everyone of a change in privacy policy due to GDPR if they don't keep everyone's emails on hand? :P

This is a tricky problem, especially because the GDPR contains some pretty strong language about people needing to specifically consent. I think nobody really knows for sure at this point, but it seems to be a lot of people's impression that things like "by continuing to use the site, you have agreed to these terms" is no longer sufficient.

For example, it specifically says that pre-checked checkboxes like "I agree to the terms" are not sufficient, the user has to check it themselves. So I honestly don't know—do I need to do something like an actual block from using the site until the user clicks "yes, I agree to these terms changes"?

No. If you click on your username (top-right) and then click on Inbox under Messages in the sidebar (right).

No, meant that as a suggestion, not a confusion.

Oh, I couldn't infer that from your previous comment. I was confused about what large post you were talking about, so I just assumed you were confused.
