Since there existed a way to get, for example, a surfing Pikachu through Pokémon Box in gen3, a Surfing Pikachu transferred via this software would be legal in gen3 smogon tournaments.

Nintendo tournaments are played in Scarlet/Violet, where you could import such a Pokémon along box/home.
However, a Pokémon in Scarlet/Violet must be battle-marked prior to being entered in a tournament. When the Pokémon is marked then any legacy-only moves, abilities etc are reset to what is possible in the current generation.
