This is the legal equivalent of a child going "I'M NOT TOUCHING YOU. I'M NOT TOUCHING YOU". Phrases like "legally distinct" aren't some magic spell you can just invoke to get away with whatever you want. Everything is still subject to human interpretation. This is an absolute slam dunk for Nintendo's legal team.
