Is it constitutional to send someone back to prison for relapsing?

    Why not instead talk about how immoral it is to send a sick person to prison for being sick... in the first place? Oh wait, there isn't actually a functional state making decisions, so anything that requires the country to come together and change has exactly buckley's chance of happening.

    When are the red bits and the blue bits going to split so people can be happy and actually get shit done?

    Reading this made me so upset. It's genuinely incredible to me that with all of the neurological understanding we have today of drug use disorders, our legal system still thinks that prison could ever be a reasonable response. I'm glad that someone is fighting this, and I actually think that cruel and unusual punishment is a perfectly apt description of what's happening.

    That being said, I was under the impression that cruel and unusual punishment cases were fairly difficult to argue. Does anyone have relevant knowledge about how likely this case is to be successful?

      I really hope it can be argued based on common sense, though I wouldn't hold my breath. Sending people who relapse to prison doesn't benefit anyone and in fact costs everyone.
